PRATICOSZP16, GENERAL COORDINATION OF ZP-16 PILOTAGE SERVICES, ratifies the following document, which remains in force without interruption:

The companies PRÁTICOS - SERVIÇOS DE PILOTAGEM DO PORTO DE SANTOS E BAIXADA SANTISTA S/S LTDA, CNPJ Nº 01.331.652/0001-71; PILOTAGE SERVICES - BAIXADA SANTISTA S/S LTDA, CNPJ No. 01.920.527/0001-05; Z16 SERVIÇOS DE PILOTAGEM S/S LTDA, CNPJ 10.303.251/0001-07; and SÃO SEBASTIÃO PILOTAGE SERVICES - SÃO SEBASTIÃO CHANNEL AND PORT PILOTAGE SERVICES SOCIEDADE SIMPLES LTDA, CNPJ No. 01.804.661/0001-32, update the BASIC PROCEDURES FOR SERVICE PROVISION

Relating to pilotage services in Pilotage Zone 16, provided to service takers with which there is no specific agreement signed, originally made available on the São Paulo Pilotage website - www.sppilots.com.br - since 21/ 01/2010, and previously Registered at the Registry of Deeds and Documents of Guarujá, under No. 111.944.

Pilotage in São Paulo, both in Santos and in São Sebastião, maintains a PILOTAGE STATION in continuous operation, with all the necessary infrastructure to support Pilotage Services, consisting of a WATCHTOWER for communications operating in the VHF band, on the channels 11 (eleven) and 16 (sixteen) of the maritime mobile service and vessels classified for the Pilotage Service.

a) The Pilot request must be made in writing, by means of a facsimile addressed to the PILOTAGE STATION (Santos 13 3261-1990 / São Sebastião 12 3892-1107), duly signed by the applicant, who must be clearly identified.

b) The request must precede, at the most, 12 (twelve) and, at least, 6 (six) hours the scheduled start time of the movement and must indicate the draft and other main characteristics of the ship and the maneuver to be carried out, as well as the contact email address. Such request must also be accompanied by proof of payment for the maneuver being requested.

c) For maneuvers to be started between 00:30 am and 07:30 am of the following day, the pilot request must be made by 06:00 pm.

d) Upon receipt of the request, a critical analysis will be carried out in the light of the rules in force, issued by the Maritime or Port Authority, and port traffic. request will be canceled to avoid compromising maneuver safety and Navigation Safety. This cancellation will be informed by the e-mail address indicated therein. In this case, a new request must be made in accordance with the previous paragraphs. 2 - If the request is in accordance with current regulations, the service time may be postponed when there is a need for technical adaptation of this time due to movement in the port and its operating conditions. The time for which the maneuver is confirmed will be displayed on the maneuvers chart displayed on the internet.

e) The service taker may dismiss the requested Pilot, without incurring any charge, provided that the dismissal is communicated, by facsimile to the PILOTAGE STATION with an advance equal to or greater than three hours in relation to the scheduled start time of the maneuver; for less advance notice, the pilot will be charged at the station or on board, as the case may be. The new request for the canceled maneuver will follow the provisions of the previous paragraphs. 

f) The Pilot will not be obliged to remain on board, if the ship is not ready to start the maneuver at the confirmed time, if the incorrect positioning of cranes and/or portainers is verified, or if it is verified the absence of any element of necessary support (tug, docker, mooring, etc.). In this situation, the Pilot will return to the Pilotage Station and the “Dismissal on Board” will be charged.

g) After starting the manoeuvre, when the Pilot remains on board because it has been interrupted, or even, when the maneuver is over, the Pilot remains on board for the convenience of the service taker, the “Pilot to Orders” charge will be made by hour or fraction of stay.

h) When, due to a sudden change in sea conditions or other circumstances of force majeure, the Pilot is unable to disembark and the Captain decides to continue the trip, the relevant amounts will be due to the Pilotage and provided to the Pilot, free of charge, accommodation and food in premises according to the standards applied to Officials. In this case, the Master must arrange for the Pilot to disembark near the nearest port, even if not the port of destination, and the Service Provider, at his own expense, will take the necessary measures for the Pilot to disembark and return to the Port of Santos by fastest means of transport.

i) The prices of the services will observe the “custom of the place” or the Maritime Authority's Price Fixing Ordinance, as the case may be. The payment must be made prior to carrying out the maneuver, as provided in paragraph b. For any additional costs, the respective invoice will be issued, due within three days. For the request of new services, the borrower cannot be in default.

j) In the case of prices fixed in compliance with the methodology approved by the Maritime Authority, in the event of art. 14, sole paragraph, II, of Law No. 9537/97, considering that the Reference Region corresponds to the United States of America, are applicable to maneuvers under similar conditions. In this way, compliance with these prices is conditioned to the dimensions of the ships (LOA, breadth, draft, GRT), as well as the clearance below the keel, being compatible with the parameters established in the ABNT/NBR13246 standard, in the PIANC and in the official reports of structural strength of bollards, piers and mooring berths. Likewise, the maneuvers themselves, the spacing between ships, the positioning of cranes and/or portainers and the mooring conditions must comply with good marine practices, safety standards and the parameters recommended in the reference publications (Arte Naval, NR 29 do MTE, Naval Shiphandling, Shiphandling for the Mariner, Tug use in Port, etc.).

k) The approved methodology for setting prices under the terms of the previous paragraph does not provide for Special Pilotage Tasks, thus including towing operations, maneuvers outside the ZP, maneuvers with ships with restrictions on machinery and/or rudder and/or disability/ absence of equipment necessary for safe navigation, as well as vessels with restricted visibility (minimum visibility distance from the sea ahead greater than 500 meters). In these cases, the prices and billing method defined by the “custom of the place” will be observed.

l) The receipt of the Pilot on board attests, tacitly, that the service taker agrees with the provisions above and that he recognizes that the execution of maneuvers by vessels involves imponderable risks, and that, therefore, the occurrence of accidents or incidents in maneuvers does not generates any responsibility for Pilotage.

m) These procedures are registered at the Registry of Deeds and Documents of Guarujá, under nº 119.754, and revoke and replace those previously Registered at the same Registry under nº 111.944.
